Terms of Service
Last updated: September 14, 2026
1. Agreement
These Terms of Service ("Terms") govern your use of the website at bluepointeit.com and the services provided by Blue Pointe IT, LLC ("Blue Pointe IT", "we", "us", "our"), including our IT consulting services and our social media management platform, which connects to third-party platforms under the app name Blue Post Social (together, the "Services").
By using the Services, or by connecting a social media account to a Blue Post Social workspace, you agree to these Terms. If you use the Services on behalf of a business, you confirm you are authorized to accept these Terms for that business. If you have a separate signed agreement or statement of work with us, that agreement controls where it conflicts with these Terms.
2. The Services
We provide managed IT, website, and social media management services to businesses. Our social media platform lets a client and the people they authorize draft, schedule, and publish content to the client's own social media accounts, and view basic engagement data. Each client uses a workspace we host and administer for them.
We may change, add, or remove features over time. Where a change materially reduces a service a client pays for, we will give reasonable notice.
3. Accounts and access
- Workspace accounts are created or approved by us or by the client. Keep your login details confidential and tell us promptly about any unauthorized use.
- You are responsible for activity under your account and for the people you give access to.
- We may suspend access that we reasonably believe is compromised, abusive, or in breach of these Terms.
4. Connecting social media accounts
When you connect Facebook, Instagram, Threads, or another platform, you authorize us, through that platform's official authorization process, to access the pages and accounts you select and to take the actions you approve, such as publishing posts and reading engagement data. You confirm that you are permitted to grant that access for those pages and accounts.
- We never ask for, or store, your social media passwords.
- You can revoke access at any time in the platform's own settings, or by asking us to disconnect the account. See Data deletion.
- Your use of each platform remains subject to that platform's own terms and policies, including Meta's Terms of Service and Community Standards. We use platform data only as described in our Privacy Policy and as the platforms' developer terms allow.
5. Your content
You keep ownership of the text, images, video, and other material you or your team upload or create in the Services ("Content"). You grant us a limited license to host, store, process, and transmit Content only as needed to provide the Services, for example to publish a scheduled post to the account you chose.
You are responsible for your Content and for making sure you have the rights to publish it. We do not review Content before it is published and are not responsible for it.
6. Acceptable use
You agree not to use the Services to:
- Publish content that is unlawful, infringing, deceptive, harassing, or that violates a connected platform's rules.
- Send spam or unsolicited bulk messages.
- Access accounts, pages, or data you are not authorized to manage.
- Attempt to disrupt, overload, probe, or bypass the security of the Services or of any connected platform.
- Scrape, resell, or otherwise use data obtained from connected platforms for purposes other than managing your own accounts.
7. AI-assisted features
Some features can suggest captions or generate images using third-party AI providers. AI output can be inaccurate or unsuitable. Review it before publishing; you are responsible for anything you choose to publish.
8. Third-party platforms
The Services depend on third-party platforms and their APIs. Those platforms may change features, limit access, reject posts, or suspend accounts at their discretion. We are not responsible for the availability or actions of third-party platforms, or for content or data once it has been published to them.
9. Fees
Fees for the Services are set out in your proposal, invoice, or agreement with us. Unless that document says otherwise, fees are billed in advance and are non-refundable.
10. Ending the Services
A client may stop using the Services under the terms of their agreement with us. We may suspend or end access for a breach of these Terms or if we stop offering a Service. When a workspace is closed we disconnect its social media accounts and delete its Content and tokens within 30 days, unless the client asks us to export it first or the law requires us to keep it.
11. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted or error-free, or that any post will be published at a specific time.
12. Limitation of liability
To the fullest extent permitted by law, Blue Pointe IT will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Services. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Service giving rise to the claim in the 12 months before the claim arose.
13. Indemnity
You agree to defend and indemnify Blue Pointe IT against third-party claims arising from your Content, your use of the Services in breach of these Terms, or your violation of a connected platform's terms.
14. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Massachusetts.
15. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date and, for material changes, notify clients directly. Continued use of the Services after a change takes effect means you accept the updated Terms.
